Supreme Court
The Supreme Court is seated in Madrid and is a unique judicial body in Spain, with jurisdiction throughout the entire national territory. It is the highest court in all branches of jurisdiction — civil, criminal, administrative and labour — without prejudice to matters relating to constitutional guarantees and rights, which fall within the jurisdiction of the Constitutional Court.
The Administrative Chamber of the Supreme Court shall hear, at sole instance, appeals brought against acts and provisions of the Council of Ministers and the Government Delegated Commissions.
It shall also have jurisdiction over acts and provisions of the General Council of the Judiciary and of the Attorney General of the State.
It shall likewise hear acts and provisions in matters of staff, administration and asset management adopted by the competent bodies of the Congress of Deputies, the Senate, the Constitutional Court, the Court of Auditors and the Ombudsman.
It shall also hear cassation appeals in any of their forms, under the terms established by law, as well as the corresponding complaints.
It shall also hear cassation and review appeals brought against decisions delivered by the Court of Auditors, in accordance with its governing law.
Likewise, it shall have jurisdiction to decide review appeals against final judgments delivered by the Administrative Chambers of the High Courts of Justice, the National Court and the Supreme Court itself, with the exception provided for in Article 61.1.1 of the Organic Law on the Judiciary.
The Chamber shall also hear appeals brought against acts and provisions of the Central Electoral Board, as well as contentious-electoral appeals brought against decisions on the proclamation of elected candidates, under the terms established by electoral legislation.
It shall likewise hear appeals directed against acts of the Electoral Boards adopted in the procedure for the election of members of the Governing Chambers of the Courts, in accordance with the provisions of the Organic Law on the Judiciary.
Finally, it shall hear the application for authorisation provided for in Article 122 ter where that application is made by the General Council of the Judiciary.
